This set of regulations („Regulations” ) defines the rules for participation in the competition „Zgarnij nagrodę nie czapkę, nie bądź tym gościem” („Competition”), as well as issues regarding its supervision and handling of complaints.
The Organizer of the Competition is Cabinest spółka z ograniczoną odpowiedzialnością with its registered office in Krakow, registered address: Al. Powstania Warszawskiego 15, 31-539 Kraków, whose registration documents are stored by the District Court for Kraków-Śródmieście in Kraków, XI Commercial Division of the National Court Register, with KRS number 0001170258, NIP 6751812931 and REGON 541579142, with a share capital of PLN 50,000 (“Cabinest” or “Organizer”). The Organizer undertakes to fund the prizes detailed in the Regulations. The Organizer is a public promisor within the meaning of Article 919 of the Civil Code.
The Competition is organized using the Instagram and Facebook platforms, where basic information about the Competition has been placed. The entire Competition Regulations are available on the Cabinest Platform.
The Competition is nationwide. The Competition is organized on the principles set out in the Regulations and in accordance with the generally applicable provisions of Polish law. The Competition is not a game of chance, a prize lottery, a mutual bet, a promotional lottery, a game whose outcome depends on chance or any other within the meaning of the Act of November 19, 2009, on gambling.
The Competition (acceptance of applications) begins on August 30, 2025, at 10:00 PM and ends on September 6, 2025, at 11:59 PM. The activities related to awarding the prize will be completed within 2 weeks from the end of accepting applications in the Competition.
Only individuals who have an account (profile) on Facebook or Instagram (“Participants” or individually “Participant”) may take part in the Competition. Cabinest declares that it is in no way affiliated with Meta Platforms Ireland Limited or any other company from the Meta group involved in the functioning of Facebook or Instagram. By participating in the Competition, the Participant is obliged to read and accept the provisions of the Regulations, and also to comply with the provisions of the Regulations.
Participation in the Competition is voluntary and free of charge.
Only natural persons who meet the following conditions during the period specified in the Regulations may be Participants of the Competition:
have an active Facebook or Instagram account;
Like the contest post published by Cabinest on the profile at https://www.facebook.com/cabinestpl or https://www.instagram.com/cabinest.pl/, add a comment below it with the answer 'The US Open hat is gone—what would you take with you on a dream stay with Cabinest?', like the Cabinest social media profile on one of the platforms listed above, and tag at least one friend in your comment.
are of legal age and have full legal capacity;
are registered and reside in the territory of the Republic of Poland;
are not employees or associates of the Organizer or any company involved in the functioning of Facebook or Instagram, nor are they persons who are in a contract of mandate or other legal relationship with these entities to which the provisions on the contract of mandate apply, and are also not members of the families of the aforementioned persons (i.e., ancestors, descendants, siblings, spouses, parents of spouses, other relatives or in-laws up to the second degree, persons in an adoption relationship and in a common-law or domestic partnership, as well as the parents of these persons).
A person who wants to take part in the Competition expresses their will on this matter by performing the competition task after having previously familiarized themselves with the basic assumptions of the Competition and the Regulations.
Each participant of the Competition can perform the competition task only once and only using one profile of which they are the administrator or editor. One natural person cannot, therefore, perform the competition task multiple times.
The Participant of the Competition or other persons may not influence the course of the Competition, including the fulfillment by the Participants of the criteria for awarding them a prize. The Organizer, in the event of detecting actions that are inconsistent with the Regulations, unfair, contrary to law or good customs, or attempts to influence the selection of the winner in an unauthorized manner (e.g., through hacker attacks, creating multiple accounts by the same person, using software to manipulate participation in the Competition), may exclude such a person or the Participant on whose behalf this person is acting from participating in the Competition.
The competition task is to perform a like (click the “like” button) on the post indicated by the Organizer within the time specified by the Organizer, like the Cabinest social media profile (Facebook or Instagram - click the “follow” button), tag at least one of your friends, and comment on this post with an explanation of the answer to the question „The US Open hat is gone, so what would you take with you on a dream stay with Cabinest?”.
The Organizer has the right at any time to immediately end the Competition or the acceptance of applications for the Competition.
Participation in the Competition and the rights and obligations associated with it, including the claim for the prize, cannot be transferred to third parties.
The Organizer, in accordance with Article 921 § 3 of the Civil Code, reserves that it acquires ownership, including all transferable proprietary copyrights to the awarded and all other results of the competition tasks, including the right to use the results of these competition tasks for promotional, marketing, and commercial purposes and to disseminate them on the Internet and through other media in a way that everyone has the right to view the result of the competition task at a place and time of their choice.
The Organizer will appoint a competition committee that will evaluate all applications and select the winner.
If a Participant removes their like of the post, the like of the Cabinest social media profile, the tag of a friend, or the comment before the announcement of the Competition results, they lose the possibility of being awarded the prize.
Within the framework of the Competition, there is 1 prize in the form of a discount for the purchase of services using the Cabinest Platform. The value of the discount is PLN 1000 gross. The prize is awarded to the Participant who meets all the requirements specified in paragraph 2 and whose comment has been deemed by Cabinest to be the most 1) creative and 2) useful for customers of the Cabinest Platform. The comments are therefore evaluated according to two equivalent criteria:
creativity
usefulness for Cabinest Platform customers.
The Organizer reserves the right not to award a prize for any reason, in particular if the Competition has little interest (a small number of completed competition tasks) and if, in the opinion of the evaluators, no comment deserves a distinction by awarding a prize.
Cabinest will contact the winner via Facebook or Instagram private message. The winner will be asked to provide their details, including their first and last name and the email address associated with their user account on the Cabinest Platform. If the winner does not have such a user account, they are obliged to create one so that the prize can be awarded. Creating an account on the Cabinest Platform is free of charge and does not oblige the winner to order any services via the Cabinest Platform.
The winner can redeem the prize by contacting Cabinest within 3 months of the prize being awarded and specifying the parameters of the service offered on the Cabinest Platform they would like to use. They then make a reservation on the Cabinest platform, paying the full reservation amount, and then contact Cabinest to arrange the details of the refund. The discount can be used once (i.e., within a single transaction). If the value of the transaction is less than or equal to the value of the discount, the price of the service is reduced to 0.00 PLN. In that case, the winner is not entitled to use the remaining portion of the discount.
The discount constituting the prize in the Competition cannot be combined with other discounts, including discount codes, individually granted to the winner. The prize cannot be exchanged for any monetary or non-monetary equivalent.
The results of the Competition will be announced on Facebook and Instagram within 5 business days of the prize being awarded or within 5 business days of the end of the Competition. The name of the Facebook user profile that was chosen as the winner will be published on Facebook. The name of the Instagram user profile that was chosen as the winner will be published on Instagram.
If the winner does not use the prize within the deadline, they are not entitled to receive another prize. Unclaimed prizes remain at the disposal of the Organizer. The prize cannot be transferred to another user of the Cabinest Platform (associated with another user account).
If it turns out that the selected winner does not meet the criteria for receiving the prize, the prize will be awarded to another user whose comment was considered the second most creative and useful for Cabinest Platform customers.
The Organizer is not responsible for the Participant providing incorrect, incomplete or untrue data that prevents the prize from being handed over.
By posting their comment as part of the competition task, the Participant declares that:
in accordance with Article 3, paragraph 4 of the Regulations, they transfer to the Organizer all proprietary copyrights to the result of the competition task (if this result meets the requirements of a work in accordance with the Act of February 4, 1994, on copyright and related rights) in the following fields of exploitation: 1) fixation and reproduction (creating copies of the work using a specific technique, including printing, reprographic, magnetic recording and digital techniques); 2) dissemination and public sharing of the work in a way that everyone can have access to it at a place and time of their choice;
they will not exercise personal copyrights, including the right to sign the work with their name and surname, and agrees to the Organizer making changes to the work;
they are the sole author of the result of the competition task and gives irrevocable consent to its further publication and dissemination on the Internet.
The Organizer reserves the right to disqualify the result of the competition task if it contains content or materials that:
may in any way violate the law in force in Poland;
may in any way violate the rights of third parties, especially personal rights, copyrights or intellectual property rights;
are discriminatory, and in particular based on gender, race, nationality, language or religion, and incite violence;
are offensive and vulgar or of a pornographic nature;
contain advertising content of any entities other than the Organizer or the property hosts cooperating with it who are available on the Cabinest Platform;
violate other provisions contained in the Regulations or are submitted after the deadline.
The Organizer may also remove such a result of the competition task from the Cabinest profile or – if the social network allows it – hide it from third-party access.
The Organizer processes personal data in accordance with generally applicable regulations, including in the manner indicated in the Cabinest Platform Privacy Policy and the provisions of the social network through which the Competition is conducted. Personal data obtained in connection with the Competition are processed solely for the purposes of organizing the Competition and awarding prizes.
Providing personal data by the Participant related to participation in the Competition is completely voluntary, but it is necessary to take part in the Competition and to be awarded the prize. Personal data is generally not transferred to a third country (outside the European Union), but the personal data of the winner, which will be published on Facebook and Instagram in the event of winning a prize, will be available on the Internet, which means that anyone who has access to the Internet can view them at any time and in any place.
Each Participant has the right to access their personal data, correct them, request their deletion or restriction of processing, transfer them to another administrator, and object to their processing.
Personal data obtained in connection with the Competition will be processed as long as the purpose of processing is current, i.e., it will be the duration of the Competition and related activities, as well as the period required by relevant tax regulations. In the case of claims, personal data will be processed until these claims become time-barred. After the personal data processing period has expired, they will be deleted or anonymized.
All requests and doubts should be directed to the personal data inspector. In addition, the Organizer informs that persons whose personal data are processed have the right to lodge a complaint with the supervisory body for compliance with personal data protection regulations, i.e., the President of the Office for Personal Data Protection.
Participants' personal data will not be processed in an automated manner, including profiling.
Any complaints regarding the Competition should be submitted by Participants in writing to the Organizer's address or to the email address [email protected].
The complaint should contain the name and surname, correspondence address, email address and the name of the Participant's profile on Facebook or Instagram, as well as a detailed description of the complaint and a request for a specific action by the Organizer.
The Organizer will consider complaints immediately, but no later than within 14 days from the date of their receipt.
The Participant will receive the Organizer's position on the complaint in the same way the Participant used to file the complaint.
The complaint procedure is voluntary and does not exclude the Participant's right to independently pursue their claims in another way.
The Organizer may, at any time for purposes related to the Competition, contact the Participants via private messages on Facebook or Instagram, by phone, by email, or by post to the Participant's correspondence address.
The Organizer will make every effort to properly conduct the Competition.
The Regulations are available on the Cabinest Platform website.
The Organizer reserves the right to change the Regulations or cancel the competition at any time without prior notice. In the event of a change to the Regulations, information about the change and the Regulations in the new wording will be posted on the Cabinest Platform website and on Facebook and Instagram in a way that every Participant has access to it.
If the Regulations are available in different language versions, the Polish version is binding and should be the basis for the interpretation of the provisions of the Regulations.
The Regulations come into force on August 30, 2025.
